Certain aspects of prosecutorial inspections of compliance with the requirements of legislation on industrial safety and labor protection in the activities of coal mining enterprises

Abstract

In this paper, prosecutorial supervision is presented as an effective means of preventing man-made consequences of industrial safety violations in the coal mining industry and constitutional provisions on safe working conditions. The specificity and scale of the consequences of intentional or negligent violations of regulatory regulations on industrial safety is such that it is absolutely impossible to exclude the prosecutor’s office from among the subjects of state power controlling the coal industry. The reasons and sequence of the appearance of specialized prosecutor’s offices are considered, the main focus of which is the supervision of ensuring safe working conditions in mines, as well as compliance with other regulatory requirements applicable to coal mining activities. Information is provided on certain issues of the scientific discussion on the problems of the organization of control in the coal industry. The fundamental approaches to the organization of prosecutorial supervisory activities are defined, typical violations of current legislation identified by prosecutors are grouped by the authors. The reasons for the violations identified by prosecutors are outlined.
